Terms and conditions


  1. Session Fee
    The client understands that the session fee is required to secure their appointment date and time. This fee is non-refundable as the photographer has set aside this date and time for this client. If the session is cancelled, the photographer retains this fee to offset loss of business. This fee does not include any images or products.
  2. Payment
    Payment for digitals and pre-printed images is due before images are taken away. 50% of additional A La Carte purchases is due within 48 hours of order, and the remainder within 2 weeks. Products and/or additional images will be available for pickup or delivery once payment has occurred in full. Cancellation of any purchases that have yet to be picked up will incur a 25% cancellation fee, and the balance returned to the client.
  3. Location
    Studio sessions will take place in our home studio. For home sessions, an additional $100 charge will be charged within Auckland; beyond Auckland, please contact for a quote. For in home sessions, the client must provide a space that is big enough to work in (must fit a 6.5 foot backdrop at minimum), and sufficient heating. Images of the space must be provided to the photographer within 2 days of the session, and clutter is to be removed before session starts.
  4. Re-shoots / Refunds
    If the client is unhappy with the gallery and requests a re-shoot, all images from the previous photo shoot will be deleted. If images from both sessions are wanted for purchase, a session fee will be required for both sessions. Digitals that have been received by the client are not eligible for a refund.
  5. Rescheduling due to illness or injury
    If the client or subjects fall ill or injured on the day of the session, rescheduling can occur if the photographer has any other spaces. Please let us know if anyone has been unwell and we will do our best to fit you in at a later date. Our studio needs to be kept germ-free as we are often hosting tiny babies who are  not immunised. In the unlikely event that the Photographer is injured, becomes too ill, or has an emergency that prevents them from attending the Portrait Session, the Photographer will make arrangements to re-schedule the portrait session. If a suitable day for reschedule is not agreed upon, the session fee will be refunded.
  6. Ordering Session
    The ordering session is when clients will view photos and make any choices regarding purchases. During this session, digitals can be taken, as long as payment has been provided (via cash or internet banking). Extra products ordered are to be paid for during this session or in accordance to (2). All financial decision makers must attend the appointment, in order to finalise decisions. Orders must be placed at the ordering session. Purchased Images will be archived for 12 months, and any unordered images will be deleted.
  7. Copyright
    The photographs, digital negatives or prints produced by the Photographer, are protected by International Copyright Law (all rights reserved) and the Photographer retains the copyright to all photos and images produced. The Client will receive a copy of the purchased digital photographs on a disc or USB. The Client may reproduce any images in any manner they like for sharing and enjoyment of friends and relatives. However, the Client must not reproduce any images for publishing or selling for profit, and must not alter any image.
  8. Model Release
    The photographer has the unrestricted right to display photographs of the client, including in photographic competitions, advertising and promotion of the photographers work, and in display in public spaces. This condition will be overruled if the client expresses during the pre-session questionnaire that they wish their images stay private.
  9. Damage to Products
    The client understands that the photographer is not liable for any damages to products after delivery. The client acknowledges that photographic works may discolour over time due to the inherent qualities of materials used. It is recommended that portraits are not hung in direct sunlight, as this may speed up fading caused by the natural environment.
  10. Indemnity
    The Photographer agrees to indemnify the Agency and the Advertiser against all expenses, damages, claims and legal costs arising out of any failure by the Photographer to obtain any clearances for which he/she was responsible in respect of third party copyright works, trade marks, designs or other intellectual property. The Photographer shall only be responsible for obtaining such clearances if this has been expressly agreed before the shoot. In all other cases the Agency shall be responsible for obtaining such clearances and will indemnify the Photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.
  11. Photographer not liable for losses
    The client understands that the photographer shall not be liable for any loss or damage arising from delay in photography completion, any loss of profits, and any loss arising from an oversight or miscommunication of a clients verbal instructions.
  12. Damage to photographers property
    The client will be responsible for any damage caused to the photographer’s property that arises from misuse or destructive behavior. General wear and tear is not the responsibility of the client. Damage that is incurred by the client or accompanied persons will be charged to the client to the value of replacement or repair of the damaged property. The client assumes responsibility of accompanying persons, including guests and children bought to the session.
  13. Force Majeure
    The client understands that neither the photographer nor the client is responsible for any loss or damage arising from any weather event, fire, civil commotion, interruption to transportation, or act of God.
  14. Cameras and picture taking during session and ordering appointment
    Please ask photographer before taking any photos during the session. Behind the scenes pictures are okay (wider set up with photographer working – please feel free to share these with the photographer!) but please reframe from taking photos of close up set ups. Please refrain from using mobile phones and other camera/recording devices during the ordering appointment.
  15. Arrival time
    Please arrive on time, and if you are running late please communicate as early as possible. Please be aware that your session may be shorter in length if you are late as other sessions may be scheduled on your date.
  16. Following preparation guide
    The client understands that the instructions given prior to the session should be followed as closely as possible to ensure a smooth session. Regardless of normal schedule, a baby or child may not behave/sleep the same as at home due to the difference in environment.
  17. Editing / retouching requests
    Photography editing will take place when processing the photos. This includes the following - lightening/darkening, cropping, white balance adjustments, skin retouching (removing anything not normally there - acne, skin flakes etc and a general light smoothing), fixing double chins (where possible). This does not include:
    -hair adjustments (colour, thickness - adding hair, removing stubble)
    -adjustments to body shape or form (bone structure, wrinkles, changing skin colour etc)
    -outfit and makeup changes (unless specified on the day) - colour of outfit, adjusting outfit by pulling pants up etc, adding, removing or adjusting makeup
    -any other specific editing requests beyond a reasonable level.
    Note that some of these edits may be possible, but will require an additional fee if the edits are extensive to cover additional editing time.
  18. Pricing
    The pricing you booked with will be held until two months after your session date, and after this, may be subject to change. Please put in your orders within this time frame to avoid any pricing adjustments.
